Kirkpatrick Partners Certification Programs and Workshops Terms and Conditions

1. Introduction Welcome to Kirkpatrick Partners. By registering for any of our certification programs and workshops, including but not limited to the Kirkpatrick Bronze, Silver, Performance Designer, Training on Trial, Igniting the Inner Fire, you agree to comply with and be bound by these Terms and Conditions.

2. Registration and Payment 2.1. Submission of a registration form constitutes a commitment to pay the full program fee as stated in the invoice. 2.2. Payment is due within 7 days from the invoice date unless otherwise agreed upon in writing. 2.3. Failure to complete payment may result in denial of program access, certification, and legal collection efforts. 2.4. Discounts or promotional offers must be applied at the time of registration and cannot be retroactively applied.

3. Cancellation, Refund, and Transfer Policy 3.1. Cancellations made more than 14 days before the program start date may be eligible for a partial refund, subject to a processing fee of $150. 3.2. No refunds will be provided for cancellations made within 14 days of the program start date. 3.3. Registrants may request to transfer their enrollment to a future session, subject to availability and approval by Kirkpatrick Partners. 3.4 Kirkpatrick Partners reserves the right to cancel any program due to insufficient enrollment until two weeks prior to the scheduled start date, or at any time due to reasons of severe weather, natural disaster, or other emergency. If your program is cancelled, you may transfer to another program at no additional charge or receive a full refund, less any fees from prior transfers if not yet paid in full. 3.5 In the unfortunate event that a program registrant experiences severe illness or a death in the immediate family during the week of the program, the attendee may transfer to a future program or send another attendee in their place at no additional charge. Refund requests will be considered on a case-by-case basis and require a doctor’s note or death certificate. Immediate family members are defined as the attendee’s current legal spouse, domestic partner, parents, children, grandparents, and siblings, and the immediate family members of their legal spouse or domestic partner. 3.6 If you wish to transfer to a future program, with notice of 14 days or more, you may attend a future program for a $100 processing fee. If you are within 14 days of the scheduled program start date, you may attend a future program for a $300 processing fee. 3.7 If you transfer a second time, another $150 – $300 processing fee will apply based on the time of transfer. If you still find yourself unable to attend after having transferred twice, you may send another attendee in your place, or forfeit your registration and any related payments. 3.8 If you wish to send a substitute to the same program, there is no additional charge regardless of number of days before event start. 3.9 Registrations are valid for one (1) year from the original booking date.

4. Program Bundles 4.1. If a participant registers for a bundled program package, all individual programs within the bundle must be completed within one (1) year from the date of initial registration. 4.2. Failure to complete all programs within the allotted time frame may result in forfeiture of remaining sessions without refund. 4.3. Requests for extensions due to extenuating circumstances may be considered at the sole discretion of Kirkpatrick Partners.

5. Program Participation and Certification 5.1. Participants must meet all program requirements, including attendance and completion of assignments, to be eligible for certification. 5.2. Kirkpatrick Partners reserves the right to deny certification to participants who fail to meet program standards. 5.3. Certification is granted solely by Kirkpatrick Partners and does not constitute a degree or guarantee of employment. 5.4. Certification will not be issued with an open invoice.

6. Intellectual Property 6.1. All course materials, including but not limited to presentations, workbooks, and online content, remain the intellectual property of Kirkpatrick Partners. 6.2. Participants are granted a limited, non-transferable license to use course materials for personal learning purposes only. 6.3. Unauthorized reproduction, distribution, or commercial use of course materials is strictly prohibited.

7. Liability and Disclaimer 7.1. Kirkpatrick Partners makes no guarantees regarding the application or effectiveness of the certification program. 7.2. Participants acknowledge that program success depends on individual effort and organizational application. 7.3. Kirkpatrick Partners shall not be liable for any indirect, incidental, or consequential damages arising from participation in the program.

8. Governing Law and Dispute Resolution 8.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Florida. 8.2. Any disputes arising under these terms shall first be attempted to be resolved through negotiation. If unresolved, disputes shall be settled through mediation or arbitration in Florida.

9. Amendments and Contact Information 9.1. Kirkpatrick Partners reserves the right to amend these Terms and Conditions at any time.
